General Conditions of Sale

1. Identification of the Seller

Secreativa.es is owned by Susana Santa-Eulalia Pérez-Medrano, with Tax Identification Number 72782629A and registered address at Av. de Reyes Católicos 29 bajo, 26580 Arnedo (La Rioja). Hereinafter referred to as "the Seller." The Seller offers bookbinding fabrics for bookbinding, scrapbooking, and crafts through this online store.

2. Scope and Purpose

These Conditions of Sale regulate the offer and sale of physical products (bookbinding fabrics and accessories) are sent by mail/parcel to the customer's address in Spain or other countries within the European Union. No digital goods or content are supplied. Placing an order implies the customer's full and unreserved acceptance of these terms and conditions.

3. Orders and Acceptance

The order is formalized when the customer completes the online purchasing process and the Seller sends confirmation by email. Validation of the order implies automatic acceptance of these Terms and Conditions. The Customer guarantees that all information provided (personal and payment) is accurate and undertakes to keep it updated.

4. Prices and Payment Methods

  • Prices: All published prices include the Value Added Tax (VAT) applicable in Spain (generally 21%). Prices may vary due to typographical errors, tax changes, or catalog modifications. If this occurs and the price is higher than indicated, the Seller will contact the Customer to confirm or cancel the order.
  • Payment methods: Payments are accepted in euros through:
  • PayPal: Through a PayPal account or with a linked bank card.
  • Stripe: by credit or debit card. Stripe is certified as a PCI DSS Level 1 payment service provider, ensuring a secure environment for card data.
  • Bizum: instant payment with mobile banking app.
  • Security: The Seller does not store sensitive bank card data or bill the card; this data is processed exclusively through secure PayPal or Stripe gateways. All methods comply with industry security standards.
  • 5. Shipping and Delivery

    • Term and territory: Orders are shipped to the peninsula, islands, and the rest of the EU within approximately 3–7 business days from order confirmation. This delivery time is indicative and may vary depending on destination and inventory.
    • Shipping costs: These charges are calculated at checkout based on the destination and weight of the order. The customer is responsible for shipping costs. For shipments outside of Spain, the customer may be subject to local duties or taxes, which are their responsibility.
    • Reception: The Customer must check the condition of the package upon receipt. If it is delivered broken or shows signs of tampering, it is advisable to note this on the carrier's delivery note. The Seller is not responsible for delays due to external causes (carrier, customs, etc.).
    • 6. Returns, Refunds and Warranty

      • Final sales: Except in cases of defect, all sales are final and returns, refunds, and cancellations are not permitted at the customer's discretion once the order has been confirmed. Customers are advised to confirm their product selection and quantity before making payment.
      • Defective or non-compliant product: If you receive a defective product or one that does not match the description, the Customer must immediately notify the Seller, providing proof (photos, description of the defect). The Seller will provide instructions for returning or replacing the defective item.
      • Exclusions: No refunds or credits will be issued for non-conformities due to improper use of the product by the Customer (misuse, unforeseen wear and tear, lack of maintenance, prolonged exposure to sunlight, etc.), nor for the mere decision to withdraw.
      • 7. Responsibility

        The Seller shall not be liable for indirect damages, lost profits, or special damages arising from the use of the products. The Seller's civil liability is limited to the price paid for the purchased products. In the event of any problem with a product, the Customer must contact the Seller to seek an appropriate solution.

        8. Data Protection

        The personal data provided by the Customer will be used exclusively to manage their orders and communications related to the purchase. The Seller complies with data protection regulations (GDPR) and will not share information with third parties except under legal obligation or for the purpose of processing the shipment.

        9. Applicable Law and Jurisdiction

        These terms and conditions are interpreted in accordance with current Spanish law. In the event of a dispute, both parties agree to submit to the competent courts of the Seller's domicile (La Rioja) or the consumer, in accordance with applicable law.
